When You Have No Title and No Registration at All

That is what Form MV-35 exists for — a statement by an owner who does not have a valid title. Four conditions apply together: only the vehicle's owner may sign it; the vehicle must be at least eight model years old; it must be worth no more than the value limit printed on the current form; and the recipient must be a DMV-registered vehicle dismantler, itinerant vehicle collector or certified scrap processor.

Two things follow from that fourth condition, and they matter. CashSellCar is not itself the MV-35 recipient — the vehicle goes on to a licensed dismantler or scrap processor in our buyer network, and the form names that business, not us.

The second is permanent: a car transferred on an MV-35 may never be titled again and must be dismantled or scrapped. It cannot go to a private party, tow driver or charity. The value limit on the form and the one in 15 NYCRR §81.8 disagree, so read the figure on your current form.

Selling a car in New York: the paperwork, in order

Selling a car in New York that no longer runs is mostly paperwork you can complete at the kitchen table. You sign the transfer-of-ownership section on the title and complete a bill of sale, Form MV-912 — the DMV requires one even when the vehicle is a gift.

Two disclosures sit on the back of the title and they do not work the same way. The damage disclosure must be completed whatever the car's age. The odometer disclosure applies only to vehicles manufactured in or after the 2011 model year that are twenty model years old or newer; for a 2010-or-earlier car it is not required.

If the title has gone missing, Form MV-902 orders a duplicate for $20, and the DMV mails it to the address on the record. Two other routes exist: a vehicle from 1972 or earlier was never titled in New York, so proof of ownership is a transferable registration signed by the seller named on it; and where a car is going for dismantling, Form MV-35 covers an owner who never had or has lost the title, subject to the DMV's age and value conditions. Confirm the current thresholds on the form itself before relying on that route.

An outstanding loan does not stop the sale. New York permits a vehicle to be sold with a lien still recorded — the lien simply carries forward onto the buyer's title. To clear it first, the lienholder signs the Notice of Recorded Lien (MV-901) and the DMV posts a clean title in roughly 60 to 90 days; a DMV office cannot hand one over the counter.

Finally, the step most sellers get the wrong way round: surrender the plates before you cancel the insurance. Use Form PD-7, keep the FS-6T receipt the DMV posts back, and note that the DMV will not accept plates with frames or fasteners still attached. If the plates are not surrendered, the DMV will suspend the registration and can suspend your driver licence with it.
