What an active lien means
An auto lender typically records a security interest on the Ohio title. The lien does not make the borrower disappear from the title record, but it gives the secured party a protected interest that must be addressed before the buyer can receive clear ownership.
Ohio Revised Code Section 4505.03 generally requires the seller to deliver an assigned certificate of title, subject to statutory alternatives such as an authorized electronic assignment. Section 4505.04 explains that a buyer does not acquire ownership merely through possession, payment, or an informal bill of sale when the required title evidence is absent.
This is why handing a junk car and its keys to a buyer does not resolve an active lien. The transfer must follow Ohio’s title law, and the secured party’s interest must be properly discharged.
Ohio law versus CashSellCar policy
It is inaccurate to say that Ohio law makes every sale discussion or payoff transaction involving a financed vehicle illegal. Ohio Revised Code Section 4505.13 includes a process through which a dealer receiving a title transfer may send the secured party the funds needed to discharge the security interest. How Ohio lien release works
Ohio titles are issued through County Clerk of Courts title offices. The Ohio BMV publishes the statewide instructions and maintains the title system.
The BMV describes two primary release paths after a vehicle loan is fully paid:
Manual lien release
If the lender holds a physical title and releases the lien manually, it marks the lien discharged on the title and sends the title to the owner. The owner takes that title to a County Clerk of Courts title office so the cancellation can be entered in the title record.
Follow the title office’s instructions rather than assuming that a generic letter is enough. The document must meet the requirements for a valid discharge and match the vehicle and lienholder information.
Electronic lien release through ELT
If the lender participates in Ohio’s Electronic Lien and Title (ELT) program, it sends the lien cancellation electronically. After the title record no longer shows the lien, current BMV lien-release instructions direct the owner to apply at a County Clerk of Courts title office for a paper title.
An electronic release is not the same as a memorandum certificate, and a lender’s payoff receipt is not automatically a transferable title. Confirm that the cancellation appears in the title record and ask the title office what ownership document the planned buyer will accept.
BMV 3774 and a missing title
BMV 3774, Application(s) for Certificate of Title to a Motor Vehicle, is used in title-office transactions that include replacement and duplicate-title requests.
- If the loan has been released electronically and the owner needs a paper title, current BMV instructions direct the owner to the replacement-title process.
- If a physical Ohio title was lost, stolen, or destroyed, the owner can ask a County Clerk of Courts title office about a duplicate certificate.
- If the title record still shows an active lien, a duplicate application does not erase it. The lender’s valid release must also be recorded.
The application may require notarization and transaction-specific supporting documents. Use the current BMV form and confirm the requirements with the title office rather than relying on a prefilled form or an unofficial copy.
A careful sequence for the seller
- Contact the lender. Ask for the current payoff instructions, where funds must be sent, and whether the lien is held on a physical or electronic title.
